TERMS AND CONDITIONS FOR tMUCH PLAY

1. ACCEPTANCE OF TERMS
By downloading, accessing, or using tMuch Play ("App", "Service", "Platform", "we", "us"), you agree to be bound by these Terms. If you do not agree, do not use the App.
2. ELIGIBILITY
You must be at least 13 years old. If you are under 18, you must have parental consent.
3. YOUR ACCOUNT
- a) You are responsible for your login credentials and all activity under your account.
- b) You must provide accurate information.
- c) One person may not operate multiple accounts to abuse streams or monetization.
- d) We reserve the right to suspend or terminate accounts at our sole discretion.
4. INTELLECTUAL PROPERTY - UPLOAD ONLY YOUR WORK
- a) You retain ownership of your content ("User Content").
- b) You may ONLY upload content you own 100% or have explicit legal rights and licenses to upload. This includes sound recording, composition, lyrics, artwork, and samples.
- c) By uploading, you grant tMuch Play a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transcode, reproduce, distribute, publicly perform, and promote your content on the Platform and for marketing.
- d) No covers, remixes, DJ mixes, or sampled beats unless you have cleared all rights in writing.
5. COMMUNITY GUIDELINES - KEEPING tMUCH PLAY SAFE FOR EVERYONE
We have ZERO TOLERANCE. You agree NOT to post or share:
A) HATE, HARASSMENT & VIOLENCE
No content promoting hatred, discrimination, or violence based on race, ethnicity, tribe, nationality, religion, gender, sexual orientation, disability. No threats, bullying, or incitement.
B) IMPERSONATION & FALSE IDENTITY (STRICTLY PROHIBITED)
You may NOT create an account pretending to be someone else. You may not impersonate any artist, celebrity, or other person.
EXAMPLE: Creating an account and calling it 'Jah Prayzah', 'Winky D', 'Jah Prayser', 'Holy Ten', or any other artist name when you are NOT that actual artist, or creating an official-looking profile for them, is a serious violation and will result in immediate permanent ban. This includes using their name, photos, and logos to mislead fans. If you are a fan page, you must clearly state 'FAN PAGE - NOT OFFICIAL' in your bio.
C) EXPLICIT & ADULT CONTENT
No pornographic content, explicit sexual content, or graphic sexual descriptions in audio, lyrics, cover art, or profile. Mature themes in music must be tagged as 'Explicit'. Gratuitous sexual content is banned.
D) ILLEGAL ACTIVITY & SPAM
No content promoting drugs, weapons, self-harm, or illegal activity. No fake streams, stream manipulation, bots, buying plays, misleading metadata, or spamming.
6. MODERATION & CONSEQUENCES OF VIOLATION
We use human review and automated systems to enforce these rules. If you violate our Terms, Community Guidelines, or any applicable law, we reserve the right to take any or all of the following actions at our sole discretion, without prior notice:
- Remove any content immediately.
- Issue a Warning or Strike to your account.
- Demonetize your content or your entire account.
- Suspend or Permanently Ban your account.
- Withhold and Forfeit any unpaid earnings if fraud, impersonation, or infringement is detected.
- Report to law enforcement where legally required and fully assist the police and other authorities in any investigations relating to your content or conduct.
- Pursue legal action against you to the fullest extent permitted by law, including seeking damages, injunctions, and recovery of legal costs, where your violation causes harm to tMuch Play, our users, or third parties.
3-STRIKE POLICY: After 3 violations for community guidelines or copyright, your account will be permanently terminated. In cases of severe violations such as impersonation, hate speech, fraud, or explicit illegal content, we may ban you immediately without warning.
7. MONETIZATION POLICY
- a) Monetization programs may include ad-revenue share, subscriptions, and tips.
- b) Eligibility is determined solely by tMuch Play and may require minimum followers, plays, and account verification.
- c) RIGHT TO DENY MONETIZATION: tMuch Play reserves the absolute and unconditional right to approve, deny, suspend, or revoke your eligibility for monetization for any reason or no reason, at its sole discretion, without providing a reason or prior notice. Our decision is final and not subject to appeal.
- d) Minimum payout threshold is $100.00 USD. Earnings below this threshold will automatically roll over to the next payout cycle.
- e) PAYOUT PROCESSING & VERIFICATION PERIOD: All payout requests are subject to a mandatory verification and processing period of 30 to 60 days (1-2 months) from the date of request.
- f) Fraudulent, bot-generated, self-generated, or artificially inflated streams will not be counted, will be deducted from your earnings, and may lead to immediate demonetization and forfeiture of all unpaid earnings.
- g) You are solely responsible for any applicable taxes, levies, or duties on earnings received from the Platform.
8. COPYRIGHT & DMCA TAKEDOWN
We respect IP rights. If your work is infringed, send a DMCA notice to: report@tmuchplay.uk and support@tmuchplay.uk
Your notice must include: (i) Your physical/electronic signature, (ii) Description of copyrighted work, (iii) URL of infringing content on tMuch Play, (iv) Your contact info, (v) Statement of good faith, (vi) Statement that information is accurate. Repeat infringers will be banned.
9. DISCLAIMER AND LIABILITY
The Service is provided "AS IS" and "AS AVAILABLE". To the fullest extent permitted by law, tMuch Play shall not be liable for any indirect or consequential damages.
10. GOVERNING LAW
Governed by the laws of Zimbabwe. Disputes shall be resolved in the courts of Harare.
11. CHANGES TO TERMS
We may modify these Terms at any time. Continued use after changes means you accept the new Terms.
